You are not fully correct. The question is not with regard to the arrest of a person with the permission of the Magistrate. The question here is whether police can directly arrest a person for offences carrying punishment lesser than 7 years, without the permission of the Magistrate. The answer is that without compelling reasons listed in CRPC, arbitrary arrests are not allowed as per Arnesh Kumar.

The problem today is automatic arrest for the sake of arrest since it is treated as a tool for intimidation and harassment and a means for adopting arm-twisting methods.

The lack of reasonableness and justifiable rationale behind police actions is what is sought to be remedied by 41A and Arnesh Kumar and DK Basu.
