30(b) " 1/4 of term of imprisonment which the magistrate is competent to inflict as punishment" which means 1/4 of the power of the magistrate and not Max punishment. Here there is a collision between s. 65(ipc) and s. 30(CrPC) . However section 65 will prevail due to various judicial precedents. The collision is only between the powers of the magistrate (30 CrPC) and not of session court.

Toh ma'am robbery ke case me sirf 3 years hi maximum punishment hoga.. Default ka 3.5 years toh add nahi hoga. Isn't it?

9 mahine ki aur imprisonment ya maximum 9 months ki imprisonment?
