Supreme Court Gives Landmark Verdict On SC, ST Quota, Allows Sub-Classification Of Quota
Supreme Court allows Sub-Classification of scheduled castes to give separate quotas for more backwards. Supreme Court, in a 6-1 decision by a 7-judge bench, ruled that sub-classification of Scheduled Castes to grant separate quotas for more backward groups within SC categories is permissible. However, the apex court clarified that while sub-classification is allowed, the State cannot mark 100% reservation for any sub-class. Furthermore, the State must justify sub-classification with empirical data showing inadequate representation of the sub-classification. Notably, the 6-1 majority judgment has overruled the EV Chinniah judgment of 2004, which held that sub-classification is not permissible.
