Towards the end of the session, you asked what we think of the media. I feel the modern media is far more likely to pick a side and report to support where they stand. When I was younger, news was the presentation of facts without taking a position for or against either side. I personally miss the days when media was impartial.

I totally agree with you. If she does have exculpatory evidence, it needs to be heard at the preliminary hearing, that's why it exists. The judge is the one who will decide if it's really exculpatory but there is no reason for a person to wait in jail until the trial for 6 months just to possibly be acquitted based upon something that could have been revealed in June.

The reason BF was not referenced in the Affidavit is because her statements were exculpatory in nature and did not support the arrest of BK. This is probably the reason there was a Brady/Giglio issue raised earlier- cops did not present exculpatory evidence. Bad news for the prosecution.

Had to be rewatch crew for both videos. Thanks for explaining all the legalese for us! This case is so interesting and I agree that they will probably have to have a hearing on this. Also, I 100% agree with Ellen, (and I don’t know how old she is but I am 58, so I have been exposed to media since color TVs were new and we only had three channels 😂) media hasn’t changed but our access to information and everyone else’s opinions has. If this had happened before social media, we would have said “Oh, there’s a gag order, we won’t know until trial what the evidence is” and people would not have the access to public documents at their fingertips. I guess that is one way the media has changed a bit now that I think about it, THEY have access to public documents at their fingertips also, so in that respect, we get the information sooner. I think the gag order has a lot of people wondering “What are they covering up” instead of “We have to let the courts go through their process without trying a case in the media be it mainstream or social media.”

Maybe her statements were the complete opposite of DMs.. and that’s why it wasn’t in the Affidavit.. this is crazy .. hopefully the families get the truth and justice their loved ones deserve

“Back in the day” _before 24/7 new cycle reporters wanted to be first, _*_but they didn’t want to be reversed_*_ just like a lawyer or judge._

They wanted to _inform the public of facts not their opinion_ about the facts *that’s the big difference* this happened because of the loss of the fairness doctrine.

*When reporters got things, wrong whether in print or electronic media stations, printed or broadcast corrections or retractions as soon as they found out* and often the reporter who fabricated stories was fired and blacklisted, not defended in court.

The State prosecutor was brought in by Idaho's defense, Attorney Kelli Ann is BF's attorney. Her attorney is basically saying noooo, this is a preliminary hearing. It can be duly bothersome for her since she lives in another State. In the very least, they need a hearing to decide if it's necessary for her to be there.What can she possibly say, that makes them think the judge will throw this out? It would have to be a smoking gun or it will just go to trial and the jury will have to decide who they believe. They have to weigh all the evidence, not what one person says
