1.What are the differences of preliminary investigation and inquest proceeding?
Preliminary investigation is the police agency's first response to a report that a crime has occurred, meanwhile inquest investigation is an informal and summary investigation conducted by a public prosecutor since the person is already arrested and detained. As a result, inquest proceeding occurs when the offender has been arrested and detained.

2.When is preliminary investigation proper?
- the person is not yet arrested
- the person is not yet detained
-there is regular filing
-determine if there is probable cause to file an information, and lastly there is no warrant of arrests yet

3.When is inquest proceeding proper?
- the person is already arrested
- the person is already detained
- it is summary in nature
-determine if there is valid cause for the continued detention
-no need for warrant of arrest

I was able to see the difference between a preliminary investigation and an inquest proceeding. Preliminary investigation takes place before the guilty party the offense is arrested, while inquest investigation is done after the offender is apprehended. What are the differences of preliminary investigation and inquest proceeding?

The Preliminary investigation will take a longer path. This allows both the complainant and the respondent to refute each other. When the complaint, via an affidavit, is filed, respondent is given an opportunity to file his counter-affidavit. While in the Inquest proceeding, the respondent is already in custody. With the affidavit of the person who personally witnessed the crime, chances are the fiscal will find probable cause. This no longer entails any exchange of affidavits. The prosecutor files the complaint with the court. The court proceeds to trial.

When is preliminary investigation proper?

• Preliminary Investigation is proper when;

1.The person is not yet arrested
2.The person is not yet detained
3.Regular Filing
4.To determine if there is a probable cause to file an information
5.No warrant of arrest YET.

When is inquest proceeding proper?

• Inquest Proceedings is proper when;

1.The person is already arrested
2.The person is already detained
3.Summary in nature
4.To determined if there is valid cause for the continued detention
5.No need for warrant of arrest

Salamat po sa bagong kaalaman. Pagkatapos mapanood ang video ay natutunan ko ang pagkakaiba ng Preliminary Investigation at Inquest Proceedings. Sa Preliminary Investigation dahil wala pang warrant of arrest ay hindi maaaring arestuhin at ikulong ang tao dahil kinakailangan ng Regular Filing at pagde determina sa presensya ng paunang impresyon.
