The Constitution of India is a unique document as it provides for affirmative action in the form of 'Reservations'. As per the intention of our constitutional makers, the reservation was to be provided only to members of the Scheduled Caste and Scheduled Tribes. However, an addition towards the Other Backward Classes was made in the decision of Indra Sawhney v. Union of India.

In this video, Mr Amlan Mishra discusses the above decision and also the Court's view on whether reservation can exceed 50% of the said seats in India.

Reservation is being misused by a few who actually no more need any reservation. Only some people are taking benefits of reservation again and again and again but those who are financially lagging are unable to take any benefit of Reservation. आरक्षण का फ़ायदा केवल मुट्ठी भर लोग उठा रहे हैं जबकि जो सच में आर्थिक रूप से पिछड़े हैं उन्हें आरक्षण का कोई फ़ायदा नहीं मिल पा रहा। कुछ ही परिवार बार-बार हर-बार आरक्षण के फ़ायदा उठाते जा रहे हैं परंतु जो सच में आर्थिक-रूप से पिछड़े हैं उन्हें आरक्षण से कोई सहायता नहीं मिल पा रहा। ७० वर्षों के आरक्षण में तीन पीढ़ियाँ आरक्षण देख चुकी हैं। कुछ परिवार बहुत आगे निकाल गए आरक्षण के फ़ायदे उठा कर किंतु अधिकांश निर्धन आज भी निर्धन ही है, अति-पिछड़ा आज भी पिछड़ा ही है। मेरा सुझाव है कि किसी भी परिवार में यदि पिता ने आरक्षण लिया तो उसके बेटों को आरक्षण नहीं मिलना चाहिए या यदि एक बच्चे को मिला तो उस परिवार को छोड़ किसी अन्य परिवार को मिलना चाहिए। एक ही परिवार के दादा, बेटा, पोता आरक्षण के फ़ायदे उठाते जाएँ और बाक़ी समाज पिछड़ा रहे यह ग़लत है। आरक्षण किसी परिवार के केवल एक ही व्यक्ति को मिलना चाहिए ताकि रेज़र्वेशन का फ़ायदा सभी परिवारों तक पहुँचे।
