First, International Maritime Law states clearly that the larger vessel (the US Destroyer) has the right of way. This is commonly known as Law of Tonnage. The reason for this is that the larger ship will have more momentum, therefor needing more time to slow down. You can see the same thing in comparing a sedan to a semi. The semi CANNOT stop the same way the sedan can.

Under that same Law, the ship cutting across the bigger vessel is WHOLLY responsible for any damage incurred. It doesn't matter whether it is territorial waters or the open sea.

Second, an 8, 200 ton ship needs a minimum of a quarter mile to come to rest from 15 knots. Cutting across the path at 150 yards is effectively less than a ship length ahead of the US Destroyer. That would be equivalent to cutting someone off on the highway with 5 feet of distance.

Under no circumstances could this be considered professional ship handling. It may have been following orders to a T, but a US Captain that pulled a maneuver like that would most likely be Relieved for Hazarding Their Command, and would lose the trust and support of his crew for unnecessarily risking their lives.

Any provocation ignoring the ‘rules of the road’ will be called unprofessional and everyone knows it’s a provocation. Now, the Russian pilot hitting the MQ9 was just plan bad airmanship and he was lucky he didn’t take himself down. His fat vodka belly probably made it tough to pull the stick full back. Now, again, back in 2001 the Chinese pulled another provocation with bad airmanship 70 miles out and their J-8 misjudged his close pass and rammed a US Navy EP-3E, both going down. Well in international airspace, the pilot of the EP-3E had to physically wrestle with the control yoke to bring that plane down in Chinese territory or put it in the sea. A provocation with an unprofessional Chinese pilot who killed himself and potentially the crew of the EP-3E. War with China? What do you think “China 2025” means? Twenty-three years before Mao’s 2048. This is already starting to be a great deal more than the Japanese move on the Pacific Rim in the 30’s.
