The judges know that objectivity principle requires a reasonable perception of impartiality. If the judge's spouse is a presidential appointee, and if the judge has cosy relationship with the Senetor's speaker, then the principle has been violated. Judges should not adjudicate this case

Justice Ogola's wife is a Ruto govt appointee. Perception of bias real or imagined is sufficient basis for recusal. And that is before we learnt that en panelling was done at 3am on Friday night and the bench sat on Saturday without notifying the petitioners.
