Sorry, LegalYou can't answer any legal questions, especially if we don't know what state you are talking about (its lawyers are licensed in many states, but not every state). We can say generally, though, that res judicata isn't really a concept that is applied between appellate and lower court proceedings. Generally, appellate courts can review the ruling of a lower court and if part of that ruling was to apply res judicata, then that ruling could be challenged on appeal.

Im quite sure res judicata doesnt restrict the case from getting appealed🧐 or is it just in our jurisdiction?
The principle binds the initial parties to the proceedings in the same level of court but does not necessarily bind the upper level courts.

Not true!!!! You can sue the same party under a different claim!!!! Here is an example i used in my Law Ethics class!!!!

When first suing a party and young have three claims (fraud, RICO, deprivation of rights) to prove, but use only one (deprivation of rights) and you lose, you can sue them later under fraud!!!!

In conclusion, when i articulated it that way, i was proven to be right!!!! Check mate!!!! WOOO!!!!

The case wouldn't be heard if the res judicata was invoked in the former proceedings?
