Many nonprofit and small business employers require all or some employees, as standard practice, to sign non-compete agreements. However, on October 1, 2022 new D.C. legislation banning most non-compete agreements goes into effect. The legislation sets out which agreements are covered, who is covered, strict criteria for agreements with exempt employees, new notice requirements, and stiff penalties for non-compliance.
