If example po may annotation ang TCT na ang owner na nang lupa ay and Landbank of the Philippines since 1995 po? Tapos Yung lupa ay tilled by a tenant farmer for 25 years without the presence and support of the owner...pero ang nakalagay pa rin na owner sa title ay yilung mga anak ng dating owner. Ano pong previleges or advantage nito sa farmer?

Hi Attorney! Paano po pag ang nakalagay sa Memorandum of Encumbrances is "Exemption from article 567 civil code is specifically served." Ano po ibig sabihin niyan?? Mortgage po yung nabili ko pong bahay. Foreclose sale po.

Attorney, galing po ng DAR at binayaran na in full ang property. may mga resibo naman. Ang clarification ko po, pag ba nagpatangal ng annotation sa title, as in hindi napo kasamang mapi-print yon pag kumuha ng bagong title sa RD? Yung naka annotate sa title ay may na-cancel narin. Annotation sa taas na bahagi ng papel, at sa baba naman ang cancelled.

Gud pm ho I hope n masagot ang question ko.
1. Sa Contract ng housing loan under hdmf may tatak ang photocopy ng TCT( may deed of assignment ang developer sa hdmf), Memorandum of encumbrance. Lahat nagng entry transaction sa bilihan ng property or Deeds of Sale ay may word n Cancelled sa statement, at bawat page ay may malaking CANCELLED. At duon mismo sa lower part ng CERTIFICATE OF TITLE ay may cancelled. Meaning ito ay Void or Fake title.
Now, lahat yan ay documented sa RD, but ang masaklap alam ng RD n void ito still nag I issue sila ng fake title duon sa new owner n nag process ng transfered title dhl nag fully paid n ang housing loan sa hdmf at, n ibenta at na ibenta nang hnd nag kakaroon ng filling for Petition for cancellation of emcumbrance. If it is not a clean Title what is the real status of this Title that we acquired from hdmf. People are not aware of it, they never inform the borrower regarding this matter. So what do we gonna do this? Thank you

Hi atty, paano kung ang awardee ng farm lot nakabayad na in a direct payment, sa unang may ari ng lupa at may titulo na ito, ngunit may naka annotate na emcumbrace hindi na certify na bayad na in a direct payment, patay na at walng surving hier, paano mapa certify ito, at kanselahin ni ROD? Good day Atty Oliva 😊 Thanks for the information you shared in this video. Sa 11:44 po you mentioned that the encumbrances should be cleared through the court for a title to be considered “clean”. What if po deed of restrictions from the developer and cancellation of mortgage ang nasa memorandum of encumbrances ng isang titulo? Need pa rin po ba ito ipa-clear? Or safe na po ba bilhin considering paid na po ang mortgage and annotated na, and the deed of restrictions po is yung mga guidelines/limits lang sa house construction ng HOA ng isang exclusive subdivision? Thanks so much po
