If Niantic hadn’t lucked into the pokemon licensing no one would even know this company exists. They don’t care about their users, or the gameplay experience. They are a data selling company that just happens to use a game as a means to harvest that data.

The delete accounts that aren’t active is sad. One of my friends died and their account is memory to me and when it’s deactivated it will be sad for me to think about it

I've studied law: They cannot legally remove your right to a trial against them if they are found of wrongdoing in the trial. It would be like a company making you sign an agreement that says you can't sue them, then they're literally just not paying you once every 3 weeks for no reason. If you sue them and prove they did wrong: They would still be required to compensate you and any action against you would be considered legal retaliation.

People regularly get this information wrong. I had someone try to argue that you need to look over the contract cause they can do that, then broke down, in detail: How they couldn't.

Maybe the opt out is their work around, but they have to put stuff like that in.

What really sucks and makes me sad is that my dad and I used to play and then he passed away. All his stuff could go away if they decide to delete his account for inactivity. All those memories gone 😞

Them adding the ability to use software to check your phone for anything they want is the most concerning one.

Niantic has exponentially gone downhill since covid

5:00 mark. My wife was a very high level in Candy Crush, to the point that she took a break, because it was becoming addictive. When she came back to the game, ALL of her power ups were gone. She emailed the makers of Candy Crush, and they essentially said that since she wasn't active, they just took it all away. She never got them back, and never played the game again.

Guys we need to have a petition or something for the new terms to be removed this is not acceptable we as a community NEED to do something about this.

Any judge who isn't bought off would laugh Niantic out of the court with that "waiving of rights". They can put whatever they want in their TOS, but if it goes against our constitution, it doesn't make it legally binding.

The fact that one of their lead game engineers has basically stopped playing and left his role, says it all.

Them deactivating unused accounts hits me because I have a friend who passed away in 2021 and I do look at his profile every so often and reminisce. Seems I'm gonna have to get a screen recording of his profile before it gets removed. Sucks his account would be removed.

Terms of service aren't even 100% legally binding because there is no proof you were the one that accepted the terms of service. Anyone in your house could accept them even a child. so, therefore, there is no way to prove that you understood or were even the one that accepted them in the first place thats why contracts have witnesses when you sign them.

I believe Discord also updated their TOS for certain countries a few months ago to waive participation in class action lawsuits as well - kinda weird to see so many of the apps I use do this

Regarding the no compensation for cancelled events.... you enter into a purchase contract with Niantic when you pay real money for a specific event. If they violate that agreement by canceling the event they most definitely have to refund you because the purchasing contract was not fulfilled

Special note about the lawsuit thing, it’s a phony to try and scare people out of it, if that was a legally binding thing, every company would be saying this

I quit in 2017-2018 and started playing again I 2023, and if I came back and I had nothing and had to start over again, I probably wouldn't have even started playing again.

The most frustrating thing is there was no advance warning that this TOS was even coming. They forced in upon players in a mandatory update.

Not refunding a cancelled event is illegal. I mean they can cancel the event purposely as a scam (which I doubt they'll do but still a possibility) but generally they are not providing the service promised. That's like saying "Oh if our icecream machine breaks down while we're making your icecream order we won't give you back the money". Just because you got someone to sign terms of service doesn't make theft legal. It's not like you can get someone to sign that you're allowed to murder them and then go murder the player. They are required to refund you if the goods were not provided.
