If you read the WARN act it applies to mass layoffs. So companies, in order to avoid this perform layoffs in waves. This keeps them under the legal limit and therefore they won’t have to notify.

My company was able to get around this WARN notice by providing “garden leave”. The laid off people are paid to stay home for 6 weeks I think it was. If they got a new job during that leave period they were supposed to tell the company which would end their garden leave.

It’s a flawed program. Lots of loopholes for companies not to comply

My company seems to have gotten around this by putting the 60 days on the back end. They did layoffs abruptly one day but it was not on the WARN notices. From what I gathered from others, they continued paying regular salary and benefits for everyone for 60 days post layoff and started their severance with no benefits after that.

As others have pointed out: companies get very creative getting around this. One company laid us off - but paid us for the next 60 days - on top of severance. We were told to tell unemployment our last day was the day of the layoff - not 60 days later. Everyone was confused. Unemployment was confused too.

There’s also “stealth layoffs”. One day a team disappears. A week later, maybe it’s your team.

If management starts telling you everything's fine even though you didn't ask, you're getting laid off.

No most companies I have been at layoff in smaller waves where they dont have to file a warn

Damn wish I had known this early July. Lay offs at my work. I was kept thank goodness but I should still check it. You never know if more are coming

Deloitte constantly has large layoffs but didn’t see their name on any of the lists for previous years.

Some states have an email list that you can sign up for so the info comes to you.

I looked into current and last few years Warn reports. There is no mention of big banks, tech layoffs listed there. But there were thousands of lay offs in each company😂

I'm actually scared of getting let go outright. My boss said they want a certain quota of work done and it seems to be a bitnbeyond my ability. I can't tell if it's reasonable or unreasonable, but I asked what the quotas would be (if any) during the initial interview and they said there wasn't one because each case was unique. Now 3 months later their giving me a quota. I could use the internet opinion on this. Not saying I'll do what the internet says but I feel like I was lied to.
