3 month notice period in India is absurd. Many countries have 2week notice period which is fine. But 3 months is way too much

Take out the payslip of the last month before putting that resignation. Then tell the next company that they didn't gave me experience certificate, the HR is asking for extra money 😂

Q. the company has not paid the salary of 7 months... and now when without serving the notice period of 1 month the employee decide to resign the company sent a letter saying 1 has to pay the notice period salary(1 month salary). Now when the company itself has not given the 7 month salary to that employee from where he will bring 1 month salary to give it to company

Time to pass labor law where a company can not blackmail employees anymore in any way. This is where CJI should put their nose and stop making selective political statements.

Laws should adapt with time.when company can fire people without notice why such long notice period.its 2weeks or less in other countries.unfortunately law is not friendly with common people.its convenience is only for rich.

Rightly said. Not only experience certificate. New company will do back ground check and experience verification. there also will get in trouble.

whether they can sue me on the basis of such contracts because our fundamental rights in constitution gives us right of freedom to choose any occupation at any time.
And the contract is violating the fundamental rights

Notice Period = 3 months. The next firm wants you to join in 1 month. The firm where you currently serve a 3 months notice period wants a new employee to also join in 1 month. The math doesn’t work. It’s exploitation of the highest level in India. The PM of the country can vacate his/her position before an employee in a firm selling biscuits can. 3 months is a joke.

Nobody asks for experience certificate, vat least in IT. If they do, its not a company that you would want to join.

As i say buy a toyota and never worry about mileage or maintaince

Buy a bmw and get reckt if u dont have 10× of amount to cover it


Same goes with partner and company

Co. will not give you experience letters Nothing else can be done by your company.

Well a lot of companies take undated cheques sometimes even blank. Sad that every-time its the individual who has to go to the court to make the world fair to live the govt. agencies never step in when required.

Notice period and Experience certificate pactices are both nonsensical.
In US, they will be thrown in jail if they mandate notice period. Its slavery.

So if found any such case it will impact your whole career

Always serve notice period. It is more of a goodwill. I don’t recruit people who don’t serve notice period in their previous companies

We can show salary slips.. that shows how much months or years you worked in that company..In addition, joining letter and yearly appraisal letters are valid proof
