Cop should be charged with assault. No reasonable articulable suspicion means the cops just assaulted this kid. They should be charged. Citizens need to start fighting back.

The Constitution works for EVERYONE on US soil. If you want this man to be treated any differently from a legal citizen, then you are asking to be subjected to the same treatment. Tread lightly.

I feel for the deceased one's family.

But at the same time, the department needs to be investigated, charges dropped, and VM released from prison. But that won't happen and we will get another update some years in the future when it's settled or goes to trial.

While it's unfortunate that the officer suffered cardiac arrest and passed, that doesn't mean that the defendant caused his death. A healthy 53-year-old doesn't suddenly die of cardiac arrest after 6 minutes of physical exertion. Many 53-year-old men work out vigorously on a daily basis and/or jog for miles at a time. It's likely that the officer had an underlying heart condition and that any manner of vigorous physical exertion would have caused cardiac arrest. And while the defendant did resist arrest, the officer had no lawful basis to detain him in the first place. Pursuant to Florida Statutes definition, the defendant wasn't trespassing. There were no posted signs, and neither the property owner nor his agent had asked him to leave. Appearing to be "a suspicious person" is subjective and is not synonymous with the statutory requirement of reasonable articulable suspicion of criminal activity. Sitting down and talking on a cell phone at a business property after dark is not indicative of a crime. Getting up to leave isn't indicative of a crime either. In the absence of reasonable suspicion of a crime, the detainment and search were unlawful. This is a case of multiple criminal charges in search of a statutory basis. It's using the defendant as a scapegoat for the officer’s demise.

... I didn't know this. If u get get someone worked up, and they stroke out.. its your fault?? I know when two ppl are mutually fighting... certain amount of harm isn't considered assault OR even murder.

Yes, definitely, I hope they charge the suspect, I hope he gets paid administrative leave. The Sargent should of just complied and waited for his day in court. Why didn’t he just comply? He’d still be alive if he just complied. Meanwhile the suspect will enjoy a paid vacation during an internal investigation where they will find no wrong doing.

Seems he should of been escorted out of the country not charged for manslaughter which means you accidentally killed someone as in not on purpose. Im sure they went with this because the DA knew a murder charge would fail. Perhaps the DA should really be the one under investigation without pay.

You’re definitely of violent struggle is a subjective here. His reaction to a cop was that of a huge lack of understanding why cop was manhandling. As you can see from many cameras from the other cops he was stripped down in pants, shirt and a phone. There was no weapon! Oh I stand corrected! I guess a phone could me considered a weapon to justify the cop escalating the situation.
The cops health is sad for sure. However they can’t blame the kid for that and shouldn’t.
