Its not a traffic violation. The DOT rule about helmet protrusion is for the manufacturer, not the wearer...

Not illegal or against DOT regulations at all. DOT regulations say this
motorcycle helmets cannot have rigid protrusions that extend more than 0.2 inches from the helmet's surface. This includes projections inside the helmet shell.


A GoPro or communication device like a cardo or a sena mounted with a glue-on or clamp-on mount is considered a non-rigid projection. These mounts are not permanently affixed to the helmet and can be removed without damaging the physical structure of the helmet.

Edit: So after further research and a shout out to a random dude in this comment section, It turns out (and you can Google this) the DOT "law" that I quoted above and the DOT laws that others are quoting actually don't apply to us motorist because we aren't the ones certifying the helmet as DOT compatible, These DOT regulations are strictly for the manufacturer of the helmets.
Now, To add onto this as I've said probably 850 times now, a number of brands that have helmets that are DOT certified come with removable action camera mounts and yet they're somehow still not only DOT certified but they also generally come ECE 22.06 certified. They've been fully tested and comply with all rules and regulations including with accessories (ECE22.06 test helmet safety with accessories on which means they attach the removable camera mounts and most likely a mock camera to avoid damaging a real one and confirm that the helmets meet all impact testing) so the helmets ARE SAFE.


And a final note, Ive learned something interesting that id like to share that's going to blow all your minds. These DOT laws you all keep quoting making cameras and Bluetooth com units "illegal".... yeah....they came out in the 70s. These units didn't EXIST and weren't even a thought in anyone's mind when FMVSS218 the DOT laws for helmets came out. The laws are SO OLD and insanely out of date that it kind of makes sense that helmet manufacturers can just slap a DOT Sticker on the back and say it meets all rules and regulations because they probably don't actually TEST for DOT regs. They build the helmets to the significantly newer and far more stringent ECE standards, Because if it meets ECE even the old 22.05 it exceeds DOT.




summarize, DOT regulations for helmets are for the manufacturer not the motorist. We don't need to follow the "DOT Regulations" for helmets because they don't apply to us, They were applied to the manufacturer when building the helmet. DOT is ancient and no longer applicable in our modern world because it's been outclassed in every way. Some Helmet manufacturers ship helmets with action camera mounts so you can attach a camera to your helmet....also much more commonly, Helmet manufacturers will even attach communication units to their helmets from the factory.

It's not illegal if they're giving you the means to do it and are saying the helmets meet all federal laws and regulations and they're selling the helmets with these configurations legally in all 50 states. You can go buy them off the shelf.

I'll be the guy here to tell the full story: So apparently after the Seargent arrived, he listened and sided with the original police officer and in the end, the motorcyclist handed over his ID and was given an infraction. However, it turns out that the law they were citing in the first place applies mainly to helmet manufacturers, and not to motorcyclists. It seems that the cops were very liberal in their interpretation of this law, and although this specific case hasn't gone to court yet, it is extremely likely it will be overturned because of the poor interpretation by the officers. Nonetheless, the motorcyclist fighting it will help to build case law around it and prevent this in the future.

For a biker, that is their dashcam. If he has an accident that wasn't his fault, he would have that video proof of him not being in the wrong.

For context California is the only state in the U.S. that does not allow attaching a GoPro on your helmet as far as I know. The reason why is because they are longer than 5mm which is the maximum length allowed on a motorcycle helmet. Other states have no such laws at all. It is totally fine mounting a GoPro on your motorcycle as long as it doesn’t interfere with your ability to control your vehicle.

If this dude is in Cali then him getting pulled over is totally justified. Wish more info was revealed from this clip.

Technically, I know for California law, it states you can't have any aftermarket protrusions 2mm or more on the helmet, meaning gopros and even some bluetooth controllers are illegal, due to the possibility of the wind and speed knocking off the equipment and having it fly behind the rider into traffic behind them. You are allowed to attach cams and such on the bike itself, but most of us riders just ignore that rule, but it is one in general.

adding a gopro isn't altering it... but... there's other verbiage that states anything added to the helmet is not allowed to protrude more than something like 0.2". Sticky gopro mounts are considered attached, where things like clip on comms mounts are not. Other things, like those plastic horns some people have, have a sticky base that falls within the protrusion l;limits, then use magnets to attach the horn.

There's so much left to interpret when it comes to helmet attachments, but a gopro on top of the helmet voids the DOT rating and would be illegal in states where a DOT approved helmet is required.
