Hello, I am in a similar process. In Nov 2023 we started EB3 process through my employer. The prevailing wage determination has already been made, a recruitment process has been done and now we are submitting the PERM to the DOL, we are currently waiting for it to be approved. BUT, and here comes my question. The lawyers assigned by my employer are telling me that, in the future (when everything is approved), I will need to leave the U.S. because in order to process my green card within the U.S., based on current law and regulations, I have to show I have always been in lawful status in the U.S. Unfortunately, applying for asylum does not count as being in lawful status for purposes of applying for a green card through an employer, so I need to apply for the green card at a U.S. consulate/embassy outside of the U.S.

Hi John, thanks a lot for your videos. May I ask some questions?

We, as a family of five, have been in pending asylum status since 2016.
In Feb 2023 we started EB3 process through my employer: Prevailing Wage Determination, Recruitment, and PERM Application in FEB 2024.
It can happen, our PERM request would be adjudicated and approved (I hope so) within the next month, and we would be able to file I-140 with premium processing payment.

But it looks like we may be called for an asylum interview any time this year. This will unfortunately interrupt our EB-3 process. And chances to get asylum under the new administration are much lower now, and we would not tempt fate.

John, in your experience, have you ever encountered cases when applicants were called for an asylum interview while in the EB-3 process?

What would be the additional and prior steps we could take to secure our EB-3 process?
