DISCLAIMER (Of course, I'd have one 😁)
Hey, you might think that this info makes me your lawyer, but it doesn’t and I’m not. Sorry, but I AM NOT YOUR LAWYER unless we have an engagement agreement. I am just providing public information here, like a library does, and am not providing you with legal advice about your situation. So, it would be totally unreasonable for you to conclude we have an attorney-client relationship just because you're viewing this information.

I worked at Walmart and they have a policy in most stores not to discuss wages. I knew that the law says that wages are private and thus a manager can't tell other what you make, but it also restricts them from keeping you from doing so.

A meeting one day had a manager explicitly tell the whole store not to share wages, which led to us promptly sharing with each other how much we made. We found out that every single woman in the store made at minimum a dollar more than their male counterparts. We also found out that the more flirty the woman was the higher her pay seemed to be.

When this information was brought up to ethics and they began doing anonymous interviews, a TON of information came out about how he was an absolute scumbag and he ended up unemployed.

My sister was fired from her first job for talking about salaries with her coworkers. But she was smart and kept the emails, so she was able to report it to the state government. They came in and forced the company to give her back pay and change her status from "fired" to "resigned".

Top 3 things i have learned from this channel
1. You can alway talk about pay with coworkers
2. Keep silent if arrested
3. Have a good lawyer

The fact that pay discussion is still taboo, amazes me.

omg that last bit struck a nerve with me lol.

I was in this special ed course in 12th grade, (I wasn't special ed, I put myself in it because you got paid in that class) and my 500 pound walking frog of a teacher kept telling us that, "Your coworkers are not your friends, they are not here to have fun or talk to you. If you have to talk to them, it better be about work, unless its about the boss, another coworker, or your salaries, because gossip is not tolerated and the salary is you boss' decision, and your boss is in control."

They would also take us to business around town where we'd work for the day for like, job experience or whatever, and our supervisor threw a hissy fit, dragged us out of the building, left her purse inside, and almost rear-ended someone. Wanna know why? Because I did something a better way than she told me to, which apparently will instantly get you fired because, again, "your boss is in control and their opinion is absolute."

Correction they can ask you about any disability if the work has some physical aspects that would disqualify them for their safety. Hence I had knee surgery so they can ask is there any reason why you wouldn't be able to lift bags of cement or something like that. They just have to word it correctly and not automatically use it as a means to not hire you.

I'm willing to bet your boss is breaking multiple laws right now 🦅🦅

How do they know if you can do things if they aren't allowed to ask if you have a disability?

They cant legally ask about disability, sex, etc, but refusing to answer will likely cost you the job.

Yup.. had my boss tell me to make sure staff doesn’t talk about pay. I looked him in the eyes and said “I’m not enforcing that policy; if you wish to then you can tell my employees that but I will not; as it is against the law.” He said nothing else lol

To add to the disability section:

All employers in the US get a tax credit for employing people with disabilities, a protected veteran, and/or have received government aid in the form of food stamps or SNAP benefits.

Technically they can ask these questions, but you're under no obligation to answer them.

Actually disabilities can be asked and disclosed to understand if an individual can perform certain tasks and also what accommodations may be needed. An example is not putting someone in a wheelchair on scaffold duty or someone with a need to use certain medication on heavy equipment.
