Why didn’t Ukraine hold a referendum to create a confederation before the war? This was a widely-held idea that even Russia forwarded. Who is going to allow Kiev to call the shots when it is down and out?

Think it's rather a minority of the Ukrainian population who are worried about this evolution.
Most of the common Ukrainians just want the conflict to stop, no matter what.
Russia didn't intend to take any territory, but the west forced them into this situation.
Their main concern was Ukraine's NATO membership, which forms a clear and present danger to Russia's national security.
As well the Minsk II agreements as the draft treaty reached in Istanbul in 2022, unequivocally prove that expanding it's territory was not a Russian objective.
Russia is therefor not going to accept any deal if it doesn't contain a permanent and irreversible assurance of (whatever part is left) Ukraine remaining neutral.
Any other deal is merely a postponement of the hostilities, with the only difference that Russia will need to defend even more territory.

Zelensky is no longer President of Ukraine as his legal mandate ran out on 20 May. His signature is worthless and he knows he is in a very precarious situation. The people of the Donbass region have already had their referendum and they voted to become part of the Russian Federation.
