I'm confused about Constructive Dismissal. It sounds like anything that could actually be used is more likely than not because it has already or is happening. Sounds like a vicious cycle that can't be won unless it's not accepted in the first place. What's the exception to this?

Can a trucking company say they have a zero tolerance policy with cell phones and can they fire you without severance if you touch your phone for just 2 or 3 seconds to check google maps out of habit when almost stopped?
