Madam Rida: regarding your strongly asserted emphasis that the police can even "refuse" to register FIR u/s 157 of the CrPC 1898. This is totally incorrect, cos the registration of the FIR is the fulfilment of the mandatory requirement of the law and this salient point is always explained by the Supreme Court of Pakistan in their judgements. The police hoodlums always pretend that they have the legitimate authority to do whatever they want to do, but this abjured mindset is patently erroneous hyperbole. The registration of FIR is not the issuance of "black warrants for hanging" or even "detrimentally prejudicial with apparent bias or evident partiality" to the accused in any way. It is simply a piece of information and thus must be registered cos the police have no discretion over it. The police can delay the registration of an FIR for a few moments to understand the contents of the FIR, that is, to distinguish whether it is a cognisable or non-cognisable offence, but can never "refuse" it. In addition to this, police need the prior concurrence of the Area Magistrate to deny the proper investigation of the alleged offence by submitting him the copy of the registered FIR along with the factual narration of the reasons for their genuine suspicion of the occurrence of the alleged illegal acts with relative cogency, that is, why the police do not want to initiate otherwise obligated investigation.
