Unless you're like me where the company lied, and I could prove it. I got unemployment for 2 months. Used it to get my health better since that place had mold and smoke galore, along with sinkholes, collapsed floors/walls and many other problems.

I am an Unemployment Adjudications Specialist (aka the guy that approves or denies Unemployment claims), the last part is technically false in my state. The employer has to prove misconduct, not just state it was misconduct. And they must prove the misconduct was willful in nature.

However, given that the person was intending to get fired and pretty much stated it, the employer would just bring that up. (That's the proof of misconduct.)

My advice: Do not EVER voice to anyone at work that you are doing things hoping to get fired. That can and will be brought up in an unemployment hearing as evidence for misconduct.

Depends on the situation; I was out on workmen’s Comp., then a car accident, when I came back with a Dr’s note they gave me a song/dance, I turned in my ID but not before getting a typed notification as to why they let me go … they notified unemployment that I quit without cause; needless to say they had to pay the unemployment to me when my lawyer handed over the paperwork!

I had people not show up for their first day. Quit. Had the balls to file for unemployment. The unemployment called about the employee. And I gladly told them "the employee never actually worked here. No hours were logged, then they voluntarily quit". You don't get unemployment just because you file for it dummies. This happened with 35% if new hires.

Government forces us to pay into the system, but we can't get paid out if the company thinks we messed up. Unbelievable. I'd rather just have my money back.

If you are in a position you hate, and want to get fired and collect unemployment before getting a new job, here's what you gotta do. There's a fine line between unlikable and mean. Walk it. You want your coworkers to want you gone, but you can't be so mean that you get an HR write up. Your work should be just below acceptable. If you completely miss a deliverable, that's a with cause justification. You don't want that. What you do want is your superiors believing they have to go over your work because it's likely to contain errors.

You have to be more of an annoyance than an asset until they would rather pay you to go away than deal with you.

As an HR professional, it is unbelievable how many unemployment claims I see for these types of terminations.

Meanwhile at my company: “Bob, we need to discuss your presentation. We believe you made a grammatical error in it that in no way relates to the subject or really anything, but it has caused us to question your commitment to us. To prove yourself, we’ve increased your workload that was already unreasonable. We will also be doing regular reviews of your work. Remember, we are family.”

I literally had a part time employee try this. Worked 20 hours in a month, then didn’t show up for two weeks so I let him go. Couple months later I hear from the city because he is appealing his denied unemployment claim, lol

Perfect example of why you should always do diligent research on these things online.

People have a tendency to see a quick headline and jump to the conclusion they want.
Well, if it sounds too good to be true or if it doesn't make complete sense, it's best to find out more.

I worked with a guy "E" whose friend owned a consulting business; E had a standing job offer in his pocket, but decided to see what he could get away with first. For months, he called out sick at least once a week, sat at his desk with his feet up reading the newspaper. Missed project deadlines saying "it's not finished" and would eventually admit he hadn't started the work, and they'd assign it to someone else. He did literally nothing productive for 6+ months before they finally let him go, and he was employed at his friend's company the following Monday.

Always appeal the unemployment decision. Every company says you were fired for cause because they don't want to pay, but a majority of them never show up for the appeals hearing. Employer doesn't show up, the get default judgement against them and you get unemployment.

While in other countries the severance pay for dismissal is 33 days per year worked by law, disciplinary dismissals carry zero pay. They can be argued before a judge, and the trial must convened and resolved within 5 days of dismissal. It benefits from free justice and a lawyer is not required, although it is not prohibited either. You are advised by judicial personnel and delegation for free

It varies somewhat by state but Bob would be wise to still apply for unemployment. Certain things are obvious grounds for denial, like theft or punching your boss in the face. But he could at least get a hearing (if the company even tries to fight his unemployment claim) and plead his case. For example, if his absenses were really misconduct, why did the company not fire him sooner?

In my state, you cannot tell anyone wether they will or will not qualify for unemployment. You simply give them the information during separation. The decision is not the employers and the burden of proof falls on the employer. You have to prove misconduct. This is why you speak with employees frequently about their performance, or lack there of, and document everything!!
