Is it unconstitutional for cops to point guns at innocent people they pull over due to a mistaken belief that a car is stolen?

Any time the cops show up, it is a high risk stop. End qualified immunity.

If a citizen accidentally pointed a firearm at a police officer, thinking they were a criminal, would they be OK with "mistaken identity" and not press charges? Imma say no.

They is no such thing as an unwritten policy. If it's a policy it must be written.

There should be no "unwritten policy" in any government agency. Especially one that permits government agents to point guns at innocent people, without consequences.

Interesting that the cops became extremely nice once they recognized that they were dealing with a powerful, rich person. If only they treated all civilians like that.

One recurring issue I see with cops is that they tend to think their mistakes are typical human mistakes, so society should just forgive and forget. The problem is that while cops are no more prone to screw up than the general population, their “mistakes” have far more serious consequences than a barista at Starbucks getting your order wrong. Like Chris Rock said, some professions just can’t tolerate human error.

It was a terrible day when "policy" came to be treated as law. If the policy was law, it would be written into the law. Law enforcement has become policy-and-opinion enforcement.

pointing guns at small children and making them lay on hot asphalt? that little girl with the pink crown on was 8 YO at the oldest. how can they possibly justify terrifying children like this. they can't possibly think that the young children were accomplices in car theft .

I've come to the conclusion there is not a single situation that the police cannot make worse

Any encounter with law enforcement is a high risk for citizens.

Thanks again, putting a child in cuffs and treating them like they even can be considered a threat just shows the level of incompetence that these police have.

Cops today: “it’s standard procedure.”

Civilians: “you pointed a gun at me for no reason. I’m scared for my life.”

Supreme Court: “police have no obligation for your safety. Qualified immunity applies.”

We have lost our civil and constitutional rights to 2 little words "officer safety"

Law enforcement has been out of control, and unaccountable, for decades. Cameras are just now letting us see it firsthand

I fail to see how an ALLEGED stolen vehicle constitutes an actual THREAT to officer safety. But they'll pull GUNS on people that don't even warrant handcuffs

Why aren't the people making these unconstitutional policies held accountable. This is a clear violation of the law. Yet they go around enforcing law. This is coming to a head. People are tired of being treated like criminals by these criminals.

I'm a 76 year-old, law abiding citizen and I've never had a serious interaction with law enforcement (beyond the usual traffic stop). I used to view law enforcement officers as brave and heroic. I realize now that that was a fantasy.

There should be no such thing as an unwritten policy. Even if it gives criminals an advantage. Unwritten means they are just making shit up as they go along.

this is no longer a Government of the People, by the People, it's a Police State

What gets me is why police have the standard of "reasonableness" in violating rights and making legal mistakes but citizens are held to a more strict standard of "ignorance of the law is no excuse".
