Scalping is, by definition, arbitrage. It may not be illegal, but that doesn't change what it is. Not all laws that should currently exist, do yet exist. I use "should" to mean the law would have broad support in both the public and legislature. If you did this with an essential good, say toilet paper, depending on jurisdiction, there are laws against such acts of "arbitrage". As I doubt this affected any essential service (Water treatment plants aren't buying their chlorine from either Ace or Amazon) this is likely perfectly legal. Does this likely only affect affluent persons with pools or hot tubs? I suspect so. Is price discrimination legal (charging the rich more and the poor less), yes it is. Does that mean that this isn't scalping? No, it doesn't.
