However, the divorce obtained abroad must be passed upon judicially by a Philippine court to prove its validity before the Filipino spouse can remarry under Philippine law through the process of Judicial Recognition of Foreign Divorce (JRD). The decision of the Philippine Court shall become the basis for the annotation of civil registry documents. Indeed, Recognition of Foreign Divorce in the Philippines requires a court case to recognize a valid foreign divorce between a Filipino and a foreigner. It allows you to correct your Philippine marriage record to reflect the divorce. Second paragraph of Article 26 of the Family Code of the Philippines: “Where a marriage between a Filipino citizen and a foreigner is validly celebrated and a divorce is thereafter validly obtained abroad by the alien Spouse capacitating him or her to remarry, the Filipino Spouse shall have capacity to remarry under Philippine law.” A valid divorce decree obtained abroad is not automatically recognized in the Philippines. It is ridiculous that the Philippines still refuses to allow divorce in the country. We are just one of remaining few backward countries who would rather keep couples in a toxic relationship or not allow them to remarry. Ano makikipagkabit na lang? I realize this law was forced since the establishment of the republic but times have changed. Whoever Senator/Congressman who will sponsor this bill, I support you.

Ang Batas Ay Iginagalang at di TAMA Na Ang Isang Mag asawa Na Ikinasal Sa Ilalim ng Pamahalaan ng For Example USA, ay Puwedeng Pakialaman Ng Philippine Laws and Not by the Gov't Ifself, Dahil Ang Ikinasal Sa America Kapag Nag Divorce di Puweding Pakialaman ng Philippines Laws Upang Baguhin O' Baliktarin ang Batas ng Ibang Bansa. Dahil Maliban Lang Kung Dito Ikinasal Sa Pilipinas

*4:50** So kaya Filipino lang ang pwede mag petition for Recognition Of Divorce? Kasi di sakop ng batas ng Pilipinas ang National Law ng Alien/Foreign ex-spouse tama? I heard pwede na daw mag petition ng new Filipina fiancé under K1 even without recognition of divorce. 🙂*

I think those who do not allow divorce in the Philippines do not know the real plight of the real man and the real woman not living together anymore and only a paper says that they are married....
Hindi ko po sinasang- ayunan ang divorce para makapanloko pa uli ....
o para maging legal ang pag-aasawa ng mga homosexuals.

My ex-husband is a US citizen now, and I can’t change May's passport's last name because my last name is in my Philippines passport was my ex-husband's last name, and my divorce here in the US was finalized a long time ago. I only paid $100 for my divorce here in the US. Now my concern is that they said I need to file for divorce in the Philippines so I can change the last name on my passport. It’s too expensive the divorce in the Philippines. Is there any way that I just submitted my divorce papers in the Philippines so I can change May the last name on my Philippines passport? I need help, please thank you

So basically, it's okay for the men to travel to the U.S. or anywhere else, and get remarried to a foreigner, but since the Philippines does not recognize it, the women are forced to remain in a legally married status so that they cannot move on with their lives, while their ex-husbands move on outside of the Philippines. This is why so many abandoned women (young and old) are left alone with children and why it is cultivated in their traditions to expect the kids to work and provide for the family (since millions of absent filipino fathers have left). No wonder so many of the women prefer foreigners. This is why religion and government does not mix in the U.S. Also the idea that divorce would only be limited to the wealthy is ridiculous. Filipinos are hard working people and will always find a way to pay for what is needed.
