Great video, wish I would have seen it when it was posted because I have been through this before with the California Highway Patrol. This tactic is very effective, however the judge has the last say. I did everything by the numbers with the exception of citing the case law you stated. The judge still failed to dismiss my case even though I never received any information back from the CHP in discovery phase( I never received the green USPS return receipt requested). I was polite, courteous, dressed appropriately and was shot down within a few minutes. I ended up paying violation, the only thing I can say about this is the CHP officer has since been fired for child pornography. So much for trusted state officials.

I was hit by one State Trooper who never reset the radar gun and it was later found out to late for me to do anything about it. I learned this Trooper pulled over 15 people for doing 65 in a 55 even if they were not doing over 55. Some of those I found out had cruise controls set to 55 yet were pulled over and had proof of the speed they were going at that time. They challenged the radar guns calibration records and it was found out that it was not reset or calibrated in over a month.

awesome job!!! I got the discovery in Napa county. chp sent almost everything, but were missing a few things. Also no radar manual but where to get it. I got it and actually saw examples that conflicted my situation on how he things he got me on radar. 30 cars....i passed then moved back into the middle of the line. yet he supposedly got me So learned a LOT, got my defense together in case the motion to dismiss wasn't granted. chp didn't show, we waited...finally moved forward and judge dismissed case...yah!!!! She did make it clear she was dismissing due to no officer, NOT the motion to dismiss. She said something about have proof I sent the docs to chp /prosecuting attorney. I did send the discovery and had signed proof with me, but wasn't sure if she said i had to sumit the motion to dismiss also?? Anyway, chp actually sent ALMOST all of it....radar log had 3 calibrations but the maintenance log showed they had the gun for 7 years?? incomplete calibration log. No traffic survey...said it wasn't required....NOT if there was one or not. Also no manual for the gun....directed me to get it from some other company.

The clerk in my county did absolutely everything to refuse me filing the motion. She said "for what?", and then proceeded to schedule a court date that I'll only know when it is once they send me an email.
