The secret to increasing your workers’ compensation settlement is to allege a cumulative trauma or repetitive work activities claim. This is especially necessary if the worker might be displaced from their job. The insurance company needs to be exposed to the full extent of the worker’s injuries and the impact on their life. This is where the cumulative trauma or repetitive work activities claim comes in.

A cumulative trauma or repetitive work activities claim is a claim that alleges that the worker’s injury is the result of repetitive work activities over a period of time. This type of claim is often used in cases where the worker has been exposed to repetitive motions or activities that have caused an injury over time. This type of claim can be difficult to prove, but it is often the key to getting a higher settlement.

When you allege a cumulative trauma or repetitive work activities claim, you are exposing the insurance company to the full extent of the worker’s injuries. This can help to increase the settlement amount because the insurance company will be more likely to settle the case rather than risk going to court. The key is to make sure that you have the right evidence to support your claim.

If you are looking to increase your workers’ compensation settlement, then you need to allege a cumulative trauma or repetitive work activities claim. This is the secret to getting a higher settlement amount. Make sure that you have the right evidence to support your claim and that you are working with an experienced workers’ compensation attorney who can help you navigate the process.

I hope this helps! Let me know if you have any other questions.

If you need surgery like lumbar but insurance kept denying it, is it better to wait or have your own private insurance pay and Bill the workers comp insurance. And would settlement be the same if you settle before surgery but down the line you get medical Benefits to have the surgery? Or get the surgery and then settle case?

Can you keep your job if you settle or sign a compromise and release? Or haven’t had the “surgery” but settle before and then get the surgery and see if you do better to get back to work

Good evening, sir. For workers comp, if I get lumbar surgery, can my spouse be paid if she’s my caretaker and has to be out of her original work?

What’s your best advice regarding settlement if the insurance approves your surgery after a year? If you are young and can go back to work, should you hold off on the surgery or risk being a little better or worse and possibly returning after? Thank you

If you have surgery do you have to wait until you fully recover to settle your case?

I worked for a year with my employer and had a specific injury last May 2023. Is it too late to add this? I have a stress claim denied and I want to appeal (I am in CA). Thank you.

Would a settlement be worth more if you go back to work if you feel better from your back injury even though the surgery got approved, meaning you have future medical care rather than getting the surgery and feeling better when the AME report is done? Appreciate your responses sir

Have you settled any workers comp back injury requiring surgery like a lumbar disc? What do some of your lump sump settlements look like for one or two discs requiring surgery? And have you settled anywhere the insurance approved back surgery and the client refused because of personal reasons?

If your AME is pretty high, but you don’t get your approved surgery for personal reasons, are you forced to retire if work can’t accommodate? What if you can get better after AME report? Is there a way to keep your job even though your AME is high?

For a workers comp first responder, if the insurance approved the surgery for two-level lumbar fusion, would that increase settlement, even if you refuse the surgery for other reasons or to get it later? Can that decrease your settlement? For workers comp requiring two-level fusion, what’s the average on those cases? Thank you

If you have a low rating when you meet with an AME doctor, does that mean you must retire if you settle your case regarding lumbar injury?

As someone who’s worked on both sides of WC claims, this is beyond unethical and downright corrupt. lol

When you settle your case, if surgery gets approved, you postpone it because of the type of surgery. You get slightly better but still deal with chronic back issues. After settlement aside for future medical care, do you get a biweekly check, or do you get a biweekly check and lump sump simultaneously? From your experience with clients (workers comp) 2-level lumbar issues, how do the settlements usually work?
