What is section 107 of CrPC?

Section 107 gives the power to the Executive Magistrate to order a bond with the person before an offence is committed. The accused person is taken to detention only if he fails to execute and abide by the bond that is ordered by the magistrate.

When an Executive Magistrate receives information that any person is likely to commit a breach of the peace or disturb the public tranquility or to do any wrongful act that may probably occasion a breach of the peace or disturb the public tranquility and is of opinion that there is sufficient ground for proceeding,

The enquiry under Section 107 CRPC must be completed within a period of six months from the date of its commencement, unless the magistrate directs otherwise for special reasons to be recorded in writing [KEDAR NATH SHAW VS NARMA DEVI, STATE]
