Hans cheated online in the past, and possibly lied about some of it. But Magnus presented no evidence of him cheating OTB (nor has anyone else), and the burden of proof properly lies with the accuser.

But _practically_ speaking, things get messy. Since Hans is the plaintiff in the suit, burden of proof lies with him (to prove defamation and damage). But more importantly, Hans's past, and the distinction between online and OTB, might cloud the issues with a jury and work against Hans. I can also imagine the defendants' lawyers arguing that Hans's own past behavior "defamed himself" and so there cannot be harm (or _much_ harm) from this matter. And so on...

If "Magnus" is worth a couple hundred rating points just for the name, well, I once played a grandmaster named Stephen Death. Yep. 1983 or 84. I was rated about 1500 so it didn't go very well.
It was 7 or 8 years before Bill & Ted had to play games against death but my friends still joked about whether I could only keep my soul if I won.
I wonder what his last name was worth for his rating?
Side note, when he introduced himself, he pronounced his last name so that it rhymed with "teeth". And he had an English accent. Not the fancy highborn one, but the goofier street urchin accent. With his kinda high voice, goofy English accent, and pronouncing it so that it rhymed more with "beef" than "teeth", it lost most of its scary impact.
I still lost.

What would happen if somebody says: "I think he cheated, I have no proof so I don't know for certain, but that is what I think". Would that be defamation? Would you lose in court for saying something like that?
