Can you fire your REALTOR? This seems like something that should be pretty easy to do but the process of firing your realtor could be more complicated than you think. It all depends on whether or not you signed a buyer broker agreement or a listing agreement and if your Realtor violated any of the terms in the real estate contract. In this video, we discuss the topic of how to fire your selling realtor and why firing your real estate agent isn’t as easy as saying “you’re fired”.

When Can you fire your Realtor? Can you fire a Realtor?

While this may seem like something that should be easy to do, it’s in fact a lot harder than you think because Real Estate requires you to sign contracts in most cases when having a Realtor represent you as a Buyer and or Seller. Whatever the reason, you may find that you want to fire your Realtor. ... In most circumstances, you cannot just call your real estate agent and tell them you are choosing to use someone else. It doesn't work that way if you have signed a legal and binding contract. Most real estate listing contracts are in fact binding.

If you are a buyer and have signed a Buyer Broker Agreement with a Real Estate Agent, then the only real way to get out of the contract assuming the Buyer’s Agent hasn’t done anything to violate the terms laid out in the contract is for the Realtor to let you out of the contract. If the Realtor decides to enforce the contract then unfortunately there is very little that can be done to get out of the agreement. Which means that if you decided to buy a home and use a different real estate agent to represent you then legally you would be obligated to pay that buyer agents commission per the terms laid out in the real estate contact.

The same is true for Sellers who have signed a listing agreement with a Real Estate Broker to sell their home. Unless the Realtor allows you out of the contract or has done something to violate the terms in the listing agreement then unfortunately there is very little you can do to get out of the contract. You do have the option of withdrawing your home from the market or cancelling the contract but unfortunately the Real Estate Agent can hold your home “hostage” to the contract if they wanted to until the listing expires. This doesn’t mean that you would have to sell your home but it does mean that you wouldn’t be able to list it with another real estate agent during that period.

In addition, there are times when a listing agreement has been cancelled but you still may be required to pay the listing agent a commission if you sell your home during a certain period after the cancellation.

What is a buyer broker agreement?

A buyer broker agreement is an agreement between a buyer and the brokerage where the realtor works that they have hired to represent them with the purchase. This agreement is generally exclusive and once signed requires you to use only that Realtor to represent you on the purchase.

What is a listing agreement?

There are several types of listing agreements but the most common is an exclusive listing agreement which is a contract between a brokerage and the seller given them exclusive rights to list the home for sale for a specified period of time.

I'm trying to fire my listing agent because he has not performed his work, he won't return my calls, he's not advertising, like he said he was going to do.... basically the whole nine yards. I'm thinking about even going down to the board and filing a complaint against him.

What if it hasn’t even gone on the MLS yet and a couple months in the contract? That you want to sell to an investor without an agent?

Most of real estate agents do not care about the well being of their clients, and they will fiercely resist you walking away. I have fired some just at the end of the contract sales when nothing happened, and they became increasingly nervous about loosing me, it feels wonderful. But even more so, hiring the agent who sits near them at the office for the new listing contract . I have also shut the door in their faces and I have declined showings, it drives them crazy, and it's sweet revenge !

Eventually I found a smart, and ethical one, and things went smoother than smooth. I'm glad for her and myself.

What happens if I wasn’t sure when I wanted to list the house and the realtor put TBD for the start date. Is that binding because it seems like she’s locked me in for life.

The most important thing to realize is that all realtors are unnecessary at best and a scam at worst. I can emphasize how easy it was to sell my last house and buy my current home by myself. Once you go through the process once on your own you will begin to question everything about realtors because they don’t really do anything.

We entered into a contract and within 2 weeks we changed our minds have have decided to go a different direction. The house has not been listed, no marketing has been done, no pictures taken only a sign was placed in the yard. They are refusing to cancel our contract and want to have dibs on any commissions per the term-6 months. Do you have any advice?

What if I like my agent but everytime I get a buyer on a good price the appraisal comes back 15k less of the agreed price. So I want to hold property for a few more years?

My realtor said she was going to show my house ( not put a lock box) she only did it once, I've been letting realtors in my house. There's no one representing my house . I text her, and she doesn't return my text.

Our agent was discriminating buyers and was really hurting us also she would post the professional photos I sent her twice she would just tell me it takes a long time and she also wanted to have as pay for closing cost we didn’t know not paying was an option she also over priced our house just to get higher commission and we were loosing money. And she told us we had to pay $500 to terminate the contract and there was nothing on paper that said that.

I am a buyer and I am in a contract with an agent that refuses to let me out of the contract. I have emailed them several times and asked the broker to assist to no avail. The contract is for a year. The agent worked with me for one month

Hi Jeb, 6 weeks ago I was going to sell my home and move to another state to be my 90 year old mothers caretaker. She decided to take another route which would leave me homeless.

I asked to cancel the contract and they refuse. It states in the contract that if I back out for any reason I am liable for 6% to the realtor.

Also, the realtor asked me why I wanted to sell my house and I told her. The exact reasons above. She told me my house was worth $74, 900.00... thanking the realtor knows best I sign the contract, two days later she told me it was worth $84, 900. and sent a new contract. And then they listed the house for $89, 900.00

In my area my house is absolutely the cheapest on the market. It's not even close by square foot, location and condition. Can a realtor even list a house on MLS for a price that is different than the signed contract?

I work with Victory Outreach, a Christian Organization, they asked me to find them group homes for their drug and alcohol program, i am a wholesaler, found a home on market 90 days in foreclosure, called the listing agent to make a creative offer, the comps will not allow for cash homes has little equity sent an LOI for SUBJECT TO, GET HOME OUT OF DEFAULT 10% OF EQUITY AND SELLER CARRY THE BAL OF EQUITY. 7 YEAR BALLON 1/2 MONTY PAYMENT 1/2 INTREST RATE. AGENT SAID HIS CLIENT WOULD NOT ENTERTAIN THIS, I ASKE IF HE INFORMED HIS CLIEENT THAT THERE ARE HOME 7 ACTIVE HOME 2 NEWER HOMES THAT HAVE BEEN COMPLETY UPDATED THAT HAVE ALO BEEN ON MARKET MORE THAT 60 DAYS, INFORMED HIM THAT WE PAY FULL COMMISION ON CREATIVE DEALS, HE SAID NO. THEN I HAD A BUYERS AGENT CALL, SAID THE SAME THING. I HAVE SKIPP TRACE THE OWNER, , CAN I CALL AND JUST HAVE CONVERSTION WITH THE MARKET ANAKLYIS AND A CREATIVE OPTION?
