The HUGE Ruling That Favors California Open Carry

Washington Gun Law President, William Kirk, discusses a huge ruling yesterday from a 3 judge panel in the matter of Baird v. Bonta a challenge to California's open carry ban. The ruling, which actually remands the case back to the District Court for a proper consideration of the plaintiff's request for a temporary injunction on enforcement of this law. The 9th Circuit has found that the District did not even come close to applying the proper legal standard and so now, we get a do-over. But the writing is on the wall that California's open carry ban is living on borrowed time. Learn what all of this means and arm yourself with education today.

There is a real problem when it takes 4 years to strike a law down but it can be passed in two weeks.

An excellent analysis of the ruling. Thank you. Unfortunately, the government here in California will continue to pass legislation that will be challenged and litigated, continuing a cycle of harassing gun owners and bleeding pro-gun organizations by using tax money to pass, enforce, and litigate anti-gun laws.

Well, I said it once and I will say it again. I lived in Cali all my life until recently. I carried a gun on me EVERYWHERE and never needed a permit for 30 years. I did not see the reason to "ASK" an anti gun state for "permission" to use my rights. Slaves ask permission. I rather be judged and survive a gun fight than see my kids and wife crying over my grave. But you do you. Slaves will be slaves

Just stringing gun owners along. The only thing that matters is gun laws being null and void. From my observations that process is getting to be impossible due to cases being thrown back to lower court for reconsideration, enbanc rulings, appeals, and unfavorable injunctions. It's all game to keep the lawyers in business.

They'll just pass a new law that does the same thing but with slightly different language. Then a few years later when that gets overturned, they'll pass another new law that does the same thing but with slightly different language and in a few years when that gets

No bill should be able to become law, until resolved in the courts, if challenged. So tired of this unconstitutional legislation designed to stand until drawn through the court system, at the cost of The People.

Its insane these cases take so long, in this case 4 years, what happened to the right to a speedy trial? granted this is not a criminal case but still.

I know California. I expect the state will IMMEDIATELY pass a law that says "Yes. you can open carry. But if you open carry AND are carrying ammo, it's now a felony". Yes. It would be unconstitutional. But how many years before it's fixed?

I looked it up. California has 58 counties, 28 of which have populations greater than 200k. The three counties just BELOW 200k are El Dorado, Shasta, and Imperial. At the top group but still ABOVE 200k are Butte, Yolo, and Marin. The smallest county is Alpine, with 1190 residents. Largest is Los Angeles, with just under 10 million. By my rough count, the top 10 counties have about 28 million residents.

Interesting that they sat on the case for four years and in that time Bruen came out of the Supreme Court. I wonder, if they would have handled this matter of rights in a timely fashion, could they have gotten away with a different outcome? Also, you know the 9th hated to remand that ruling back down.

I personally would never open carry, but as a court case and it being about the 2nd amendment this needs to get a win in favor of the people. Lets say the people win, that only means California can open carry but not other states. This do needs to go the Supreme Court and be decided once and for all of the country

What I like about this channel. William lays out a lot of information in a short amount of time, in an easy to understand way. Other channels, who will remain unnamed. Make it a ponderous tome, that becomes an exercise in patience.
