Should Hijab Be Mandatory in Muslim Countries? Dr. Shabir Ally & Dr. Safiyyah Ally

#Mahsa Amini died in police custody after being charged with violating laws about modest clothing in #Iran. Women are taking to the streets in protest. Should an Islamic state enforce the hijab? Dr. Shabir Ally says the Muslim polity has a basic responsibility to command good and forbid wrong. He says Muslim woman's clothing has been much misunderstood in Islamic law, such that covering of the entire body is presented as a given, rather than recognizing that there are gradations to modesty. He says that during the time of the Prophet, peace be upon him, it is not so clear that the modesty standards that we consider essential were in place. Dr. Safiyyah Ally says that even if something is deemed obligatory religiously, that does not mean the state must have laws commanding it. Too many laws make people rebel, but she says a Muslim culture will naturally develop in Muslim majority countries which will guide the people in developing social mores.

Hijab meant for modesty and protection against men of bad desire. But enforcing law to the extend punishing free haired women is an act of transgression, and Allah hate transgressor. “Fight in the cause of Allah those who fight you, but do not transgress limits; for Allah loveth not transgressors." (al-Baqara, 2/190)

Prayer is meant to be personal. A man or a woman not praying has no detrimental effect on a society. Me not praying isn’t going to affect a women in any way. It’s only going to increase my sins but that’s not the case with not enforcing Hijab or not lowering one’s gaze. It’s like me saying that I can stare at women in an Islamic society and the government has no right to enforce any penalty on me which is ridiculous. The verse 24:30 commands me to lower my gaze first and then 24:31 tells women to lower their gaze and to wear modest clothing. Now if an Islamic society stops enforcing these laws and stops taking action against a woman who doesn’t cover properly and a man who lusts after women then it would lead to disorder and chaos in the society. Because both of these acts are public sins, they’re not private sins like not praying etc. So it’s like comparing apples and oranges.

To the admin and one who is running this Channel!
Salam Alaikum wa Rahmatullah!
This is Reza from Afghanistan. Most probably you know about the recent brutal attack in a Hazara(Shia) educational institute in DashtBarchi Kabul Afghanistan. After Taliban seized the power in Afghanistan our country has become the safe hangar of terrorism and extremism.
I request you to talk about this issue in the next show of yours.
Remember that you've made so many videos about a girl (Mahsa) who was killed in Iran but you are still mute about 53 Hazara school girls martyred on 30th September (Juma day).
Thanks

If the hijab was simply a private act of worship (like salat), why do we not have to wear it in private?

From what I know, there are 3 types of Laws in an Islamic State. 1 Laws for all citizens and non Muslims. 2 Laws for Muslims only that have prescribed punishments. 3. Laws that are between you and Allah, not the government. Wearing a Hijab has no prescribed punishment, neither does missing prayers.

There are too many misogynistic elements stalking this channel. May Allah bless you Dr Shabir. I wish there was a personal platform where I could thank you and tell you stuff without stiff people barging in with their preachy comments.

Thank you for this discussion. It is indeed very enlightening. For us in Malaysia, from my viewpoint, the hijab has actually effectively divided the peoples of Malaysia, because it becomes a "holier than thou" badge in a multi-cultural society where we are already different enough in terms of culture, language and skin colour, and so when the Wahabis stated to impact Malaysia in the 90s, and introduced the Hijab quickly proliferating it, firstly because of peer pressure and societal pressure and then only personal conviction, the gulf of separation widened even more, and then of course political parties took advantage of this separation and widened the gap further.

Allah said "But continue to remind. For certainly reminders benefit the believers." (51:55)

He did not say "But continue to enforce. For certainly enforcements benefit the believers"

Ask yourself this
Would you want to be forced to wear something day in day out, wether you wanted to or not?

I know I wouldn’t.

Wearing the veil is personal thing it’s also open for interpretation there is nothing in the Quran says you should dress specific way nor it should be forced it’s not even a sin.

To my understanding a simple logic is if you cannot force religion on anyone, it is Allah's Hidaayah(God's Guidance to whoever He wants) then why force certain aspects of religion such as in this case which is Hijab. Please correct me if I am wrong. JazakAllah Khairan!

I always enjoy listening to Dr. Shabir's discussions and points of views about Islam. Alhamdulillah, they're so interesting and so well thought out. I really appreciate Dr.Shabir taking the middle path approach, not too liberal (do whatever you want) and not too extreme (do whatever you're told, like it or not). Thank you, Dr. Shabir. May Allah bless you for your efforts.
