India's Independence Day was celebrated for the first time on this day. Until independence on 15 August 1947, Independence Day was celebrated on 26 January only. To give importance to the date of declaration of Purna Swaraj on 26 January 1930, the Constitution was implemented on 26 January 1950 and 26 January was declared as Republic Day.

38:39 26 Jan had a special significance as for the first time in the freedom struggle history the freedom fighters in the Lahore session under nehru adopted " Purna Swaraj", before that they wanted just the right to form laws.. and every year independence day was celebrated on 26 Jan before getting actual independence on 25 August

so to give the significance to that spirit.. 26 Jan was decided

Punitive detention is to punish a person for an offence committed by him after trial and conviction in a court. Preventive detention, on the other hand, means detention of a person without trial and conviction by a court.
