'Presidents Are Not Kings:' Judge Orders Don McGahn to Testify in Impeachment Probe

A federal judge has ordered former White House counsel Donald McGahn to appear before Congress in a setback to President Donald Trump’s effort to keep his top aides from testifying.

The outcome could lead to renewed efforts by House Democrats to compel testimony from other high-ranking officials, including former national security adviser John Bolton.

Judge Ketanji Brown Jackson ruled Monday in a lawsuit filed by the House Judiciary Committee.

McGahn was a star witness in special counsel Robert Mueller’s investigation, and Democrats wanted to question McGahn about possible obstruction of justice by Trump.

That was months before the House started an impeachment inquiry into Trump’s effort to get Ukraine to announce an investigation of former Vice President Joe Biden.

The constitution specifically states that a sitting President has the right to have any case against him heard in the Supreme Court... No lower court may rule in any case involving the sitting president...period.
The Separation of powers clause prevents even the Supreme Court from compelling testimony from an administration official against the will of the President.
Furthermore it is tantamount to compelling a defendant to testify against himself.
The ultimate question in American law is; What is the remedy in the case of an unconstitutional ruling by the Supreme Court?
Phrased another way; What is the remedy if the Supreme Court refuses to uphold the Constitution?
Nixon resigned rather than complying with an unconstitutional Supreme Court ruling.
Thomas Jefferson was right about the every 20 years...thing.

If the White House senior advisors and staff had grounds to invoke executive privilege in regard to their testimony Mr. Trump would have done so instead of the farcical phantasm of "executive universal immunity" which any competent attorney would have advised was not going to survive a federal court review.
