Section 26 & section 121 of Bharatiya Sakshya Adhiniyam 2023
After repeal of the Indian Evidence Act,1872, Bharatiya Sakshya Adhiniyam, 2023, is in foce. Provision containing Dying delaration can now be recorded under section 26 of new Act ( in place of section 32 of old Act).Similiarly, provision relating Estoppel is contained in section 121 of new Act (in place of section 115 of old Act). Likewise, provision as to Courts may presume certain facts, is given in section 119 of the new Act that is BSA ( in place of section 114 of the old Act).
