In this episode of the Perspective Prog. based on All India Judicial Service
On the show today we’re going to talk about the All India Judicial Service a proposal to centralise the recruitment of judges at the level of additional district judges and district judges for all states. In the same way that the Union Public Service Commission conducts a central recruitment process and assigns successful candidates to cadres, the All India Judicial Service seeks to establish a national-level recruitment process for lower judiciary. Amid reports of the Centre renewing attempts to build consensus with state governments and High Courts on setting of the All India Judicial Service, the government informed Parliament during its just concluded Winter Session that only 2 states - Haryana and Mizoram, and two high courts, Tripura High Court and Sikkim High Court, are in favour of creating the AIJS. Eight states- Arunachal Pradesh, Himachal Pradesh, Karnataka, Madhya Pradesh, Maharashtra, Meghalaya, Nagaland and Punjab – have opposed the idea, while five states - have sought changes in the government’s proposal, 13 states did not respond. And as per govt data on High Courts, 13 have opposed the proposal, six have sought changes in it and others have not responded. In Perspective today, we will analyse with eminent experts on what the All India Judicial Service entails, whether it will strengthen the overall justice delivery system, the reasons why it is being opposed by states and High Courts and what is the way ahead?

A common consensus is there with the judges who retired from the service . The real problem lies with those who are still there in the High courts.

His(J. Chauhan) last Part has a flaw. When it is not deemed to be amendment under 368 it can just be implemented with ordinary majority in Each house after Rajya sabha Passes resolution with 2/3 majority.

The all India judicial service is a need of the time but it should not be like IAS or IPS having no responsibility or accountability to the people just an imitation of ICS of our colonisers. Their ability and disposal of cases with skill and application of mind, knowledge of law and sagacity, is integrity should be assessed from time to time for their continuation in service and further promotion to higher judiciary.

There is nothing wrong in The AIJS as far as a 'Concept'of Recruitment is Concerned but the Real Concern is the Impartiality and Transparency of the Judicial Institutions
Political parties will ruin the Judiciary as they did with Bureaucracy..
Favouritism will Replace the Honesty

Having AIJS like UPSC will bring sub-standard candidates into judiciary. An inefficient judiciary like inefficient civil services, will. Ring anarchy like situations

Make English has official court language, no regional language. The whole system in India for example land records etc should have just one language English only.
