I would like to seek advice regarding the reservation agreement I signed:

"Sales Document and Other Buyer Requirements

Should I fail to pay any of the amounts due in relation to my purchase of the Property, or fail to submit the required documents and execute the relevant contract to sell and deed of absolute sale for the Property, or fail to comply with any of the terms of my purchase, the seller shall have the sole option to (i) cancel the sale and forfeit in its favor all payments made, including the Reservation Fee, to be applied as liquidated damages; and/or (ii) impose penalty charges at the rate of 3% per month (or fraction thereof) of delay on the unpaid amount. Late payments will only be accepted upon payment of interest and penalty charges. Should there be a cancellation of this reservation, and the same shall automatically vest upon the seller with full authority to sell and dispose of the Property subject to this Reservation Agreement."

I am concerned about losing everything, especially with the clause stating that all payments may be forfeited as liquidated damages.

Sir..thanks po sa info. May tanong lang po ako. Pano naman po kapag ang developer ang hindi po nagpapakita? Then yung CTS ko ang tagal ko ng pinafollow-up sa kanila pero wala pa din po sila pinoprovide. May batas din po ba doon? Kasi since December 2021 pa po sila walang paramdam sa amin, tapos stop development din sila sa Subdivision.

Dapat talaga ibigay ang Refund ng may interest kung ang Developer ay hindi itinuloy ang pagpatayo ng unit na binabayaran ng Buyer.

Question lang, sana mapansin, scenario: RFO unit ... nag full dp kana tinangap na ng developer ung full DP . then on the process sa loan sa PAGIBIG nadecline dahil late na nakita na ung coborrower eh meron ng recent loan. ang resulta nag recompute then lumabas na may loan balance na need isettle let say 500k para maapproved ung loan . ang question po may chance ba magrefund ng DP? if yes ilang percent ang possible marefund? if not ano po ang possible na mangyare sa property at mga options na pwedeng gawin ni buyer kung sakaling hindi nya kaya bayaran yung loan balance in cash. salamat po

Quetstion lang po. Yung brother ko kasi kumuha ng unit sa isang subdivision. Natapos na nya bayaran yung equity for 24mos. Kaya lang po during processing ng loan sa pag-ibig namatay po yung brother ko. Possible pa po ba na marefund namin yung nabayaran nya na equity?.
