Marine investigator James Wilkes joins Ben Kentish to discuss the revelation that Italian prosecutors are exploring a manslaughter or even homicide angle after the sinking of Mike Lynch's Bayesian superyacht.

British tech tycoon Mike Lynch and his 18-year-old daughter, Hannah, were among those recovered after the vessel sank near Porticello at around 5am local time on Monday.

Hannah was found alone in her own cabin 50 metres below the surface, rescue workers revealed during a press conference on Saturday.

Five others were found in a separate compartment: Hannah's father, Mike Lynch, Morgan Stanley International bank chairman Jonathan Bloomer, his wife Judy Bloomer, Clifford Chance lawyer Chris Morvillo and his wife Neda Morvillo.

Meanwhile, the body of Canadian-Antiguan national Recaldo Thomas, who was the chef on the boat, was recovered close to the ship on Monday.

Speaking in court on Saturday, Ambrogio Cartosio, public prosecutor of nearby town Termini Imerese, said that his office has opened an initial investigation into manslaughter.

He said that "behaviours that were not perfectly in order" may have been behind the number of deaths off the coast of Sicily at a news conference on Saturday.

But all lines of inquiry are being considered, he said.

Firefighter Bentivoglio Fiandra said the yacht had already sunk when they received the emergency call.

It was on its right-hand side with those who died having been "trying to hide in the cabins on the left-hand side" of the vessel.

"You may want to know where we recovered the bodies of the victims. I can tell you... that the ship sunk and was laid onto its right hand side at the bottom of the sea," he said.

"It's quite clear that the people were trying to hide in the cabins on the left-hand side and we found the first five bodies in the first cabin on the left-hand side and the final body in the third cabin on the left-hand side.

"There were six cabins: three on the left-hand side and three on the right-hand side. We found them on the highest part of the ship going towards the surface."

I was in Italy when this happened and there were a lot of false statements made with regards to the circumstances behind the actual sinking of the yacht.
Within 12 hours of it happening, things started to smell a little fishy!
The fact that Lynch's business partner died just the week before makes this look even more like it was less an natural accident and perhaps more done on purpose

come on, his partner dies two days before then this yacht sinking in an area that is famous for the Mafia...and nobody can really explain why this yacht was sinking and even more nobody can explain why the passengers couldn t get out while the crew could....no way

We know it was freakishly windy; we know that mast is uneccessarily (and freakishly tall) and we know that the keel was mostly retracted. With those variables, that mast doesn't even need to be blown beyond a certain point away from the vertical. I wouldn't be surprised if, after about 20º from vertical that thing was doomed to be flat on the water within seconds. And once flat, there's no sail area to stop that huge extended weight continuing the roll. With all those luxurious sliding doors into the lounges and various other openings the sea would be rushing in like an express train.

The reality of it is that the passengers thought they were sleeping in a Boutique hotel on Land with a Sea view ?
Without a care in the World but in truth they were sleeping above 50 meters of water with just the skin of the Hull between them ?
I've been on the North Sea for over the last 20 years and there's nothing Glamorous about it whatsoever !
Even in the Hot summer months the Salt and the wind begin to grind you down after a week offshore !
Being perfectly frank if you can't Crew a Vessel I don't think you have any business going near the Sea as its plain to see in this tragedy that the people who died weren't the Crew ?

Boat building in the EU is extremely strict. A boat MUST be able to withstand certain strengths of weather formations without sinking. Yes upper parts of a boat may get damaged, things such as masts and rigging BUT the main structure of the boat must be able to stay afloat BUT it can only do this is a specific set of procedures are followed, which is as many journalists have reported on, ALL windows and doors MUST be closed. What is not being explained to the general public is that all windows and doors on a boat must be water tight when closed, meaning no water can get in. If proper procedures were followed then the yacht would have not sunk, yes the people inside would have probably been bumped and bruised a bit by the turbulence of the weather BUT they would have survived. The owner of the shipyard that build the boat has already made a statement that the boat would not have sank if all correct procedures had been followed. The thing is that no one knows right now is was there a catastrophic failure with the boat that caused it to sink OR was incorrect procedure followed which caused it to sink (window or door left open). No doubt the yacht will be rescued from the seabed and it will then be possible to see if any of the windows and/or doors were left open or if the yacht suffered some kind of structural failure.

Any boat master/owner will tell you that the rule of the sea is that when in trouble the captain of the vessel is to make sure that everyone is safely off the vessel before the captain is, the captain is ALWAYS the last person off the vessel. This is the responsibility a captain takes when they want to be a captain. You give your life so that others may live. It appears the captain of the yacht did not do this and jumped off the yacht to save his own life before that if crew and passengers. This is why there are investigations going on because if the yacht was to sink the ONLY person that should have been found in the sunken yacht was the captain but instead they found passengers. This is not how the rules of the sea works.
