So I have a question that hopefully someone with any law knowledge will answer. Undergoing a child custody case, and an ex friend told my ex everything I’ve ever vented about, and probably showed her messages. Can this ‘be used’ against me since I never directly said it to my ex? I’d like to think if venting about an ex was usable in court, every child would live in foster care. Not to mention it’s essentially hearsay

Some courts have actually ruled that involving the 5th and refusing to talk can also be used against you now in some civil cases like divorces, custody hearings, protective orders, etc. Judges are allowed to assume you did something bad or adverse.

Sometimes simply insisting that you want to talk to your lawyer prior to answering any questions by police is preferable. Your not technically refusing to ever cooperate, just giving yourself time to consult a legal expert before you commit to further interviews
