President Rule in Maharashtra : Article 356 President Rule and State Emergency

With President's Rule imposed in Maharashtra after the governor had invited the NCP to stake claim to form the government after the Shiv Sena and BJP failed to prove the majority; In this video, let us Discuss Article 356 of the Indian Constitution which talks about State Emergency also known as President`s Rule.

Part 18 of the Indian Constitution covers the Emergency Provisions from Article 352 - Article 360. Article 356 talks about State Emergency

The provision for the suspension of fundamental rights had been taken from = Weimar Constitution
The idea of emergency in the Indian constitution was taken from = Government of India Act, 1935.

- Important Amendments regarding Emergency:-
-38th Amendment
-39th Amendment

-42nd Amendment: This is the most controversial amendment in Indian Constitutional history. 42nd Amendment is very important as it did major changes in the federal structure of the Indian Constitution - it is also known as Mini-Constitution

-and 44th Amendment - which was mainly introduced to do away with the changes of the 42nd Amendment. Both 42nd and 44th amendment are very important topics of the proclamation of national emergency.
