Double Risk or Double Disadvantage
Preconditions for application of Double Jeopardy protection :
- Same offense
- Same facts
- Prior conviction or acquittal
Double Jeopardy protection will not apply :
- A different offence, from the same act Different facts
- Previous prosecution was not concluded
