To take cognizance is a judicial act. it is a process where the court takes judicial notice of an offence so as to initiate proceedings in respect of the alleged violation of law. The offence is investigated by the police. The court is not bound by the report of police submitted u/s 173(2) of cr.p.c. if report of police is not making out the case still if magistrate considers that case is made out he can reject the report and take cognizance.
