I was charged with a third- degree DWI here in Minnesota end it said that I refused to submit to a chemical test when I never did. It was weird being charged that and they immediately took away my driving privileges and saying that I blew a 0.25 on the breathalyzer test. And according to third-degree description, it’s for people that had a prior DUI in 10 years or refusal to submit to a test. Am I being wrongfully charged? I wasn’t even driving, my car was parked and they were already outside when I walked outside of the restaurant, I’m wondering what their probable cause was.

Machines that provide evidentiary breath test results are calibrated frequently, and trying the "well the machine test results are false" without providing your own to back that statement up, like a blood test, is just stupid. Evidence of past good behaviour doesn't cast any doubt on the fact you were DUI. My god. How are you a lawyer
