Can Universities refuse to refund the fee paid by a student when the student wants to leave the institution midway due to unforeseen circumstances?

Law is on the side of students who want to leave an institute or course mid-way and are seeking refund of fees.
In the case of Fiit Jee Ltd./P.T.Education & Vs. Dr.(Mrs.) Minathi Rath & Ors; REVISION PETITION NO.2660 of 2007, the State Commission held in 2006, that the clause “ fees once paid is not refundable” was “unconscionable and voidable”. The forum further directed all educational institutes not to charge fees for the whole duration of the course in advance by way of lumpsum payment.
Also, in the case of Islamic Academy of Education Vs. State of Karnataka (2003) 6 SCC 696, the Supreme Court had condemned educational institutes charging the entire fees upfront and had said that students should only be asked to pay fees for a semester/year to begin with.
Thus, it is the duty of both the educational institutions and the students to be prudent and reasonable both legally and ethically while drafting contracts while getting admitted in educational institutions.
