How to Get a 100% VA Rating for Chronic Pain!

Did you know you might be eligible for a 100 percent VA disability rating for chronic pain? Yep, it’s true. Even though there is no separate VA rating for pain, you might be able to at least get awarded the minimum rating of 10% and could get up to a 100% rating if you have daily chronic pain that’s led to depression and anxiety.

If you’ve filed a VA claim for a musculoskeletal disability there’s something called The Painful Motion Principle. This means if you have any pain upon movement, regardless of your limitation of motion, the VA is required to award the minimum compensable rating of 10%.

In addition, there’s a mental health claim called Somatic Symptom Disorder, which means you have such an intense focus on your pain that it’s led to depression and anxiety. You can file a mental health claim for Somatic Symptom Disorder (Chronic Pain with depression and anxiety) secondary to a physical condition you already have service connected. This mental health claim can be rated from 0% to 100% with breaks at 10%, 30%, 50%, and 70%.

I have a 60 percent disability rating right now, but I got hit by a humvee while I was a saw gunner in another humvee during a training mission but the the VA keeps saying that it wasn't military related.

Confirmed degenerative disc disease and stenosis in my lower back and herniated disc at c6-7. MRI was don’t by the VA. Currently at 90% and going for the 100. Hopefully they actually refer to the facts instead of just some measurements.

For any muscular and skeletal pain that gets better or worse either during the day or day to day. It’s important to be very specific and articulate how the pain is at its worse and how it affects you.

For example if when you wake up, you have to stretch for 20-30 minutes. Couple this with already service connected sleep disorders.

For those who continue to serve this adds the stress on how this will affect one’s career.

I am working on a DIC claim...My case is so complicated because yes I became disabled at 17 due to many disabling injuries from a car accident including my left femur and knee plus a head injury which cause mental health disorders. Later I fractured my neck in 3 places and broke both ankles, heel bones, more than 10 bones in each foot. I've had over 25 broken bones and 30 surgeries! Ive been under PM for years. The VA has been sent my Duke Medical records but now want another letter from my Orthopedic Surgeon. I was approved in the beginning then they decided they want more evidence!

That’s what I have for my back is Pain and is starting to come into my life since last year more frequently. From my upper back all the way down my lower back and or vise versa. This pain is a pain in the butt no joke . I’m not service connected for my back but I’m diagnosed with mild arthritis from my back and I also have mild Scoliosis also . I’m receiving a lot of stuff for my back like the patches and cream for my pain and since I have a hairy back them patches are not sticking on my back when I’m sleeping or walking around wearing them due to them sometimes falling off .

My disability ratings are as follows:
10% for Hallux Valgus (I have this in both feet but only one side is rated)
10% for Ankle sprain with degenerative/osteoarthritis
20% for Lumbosacral strain
10% for Bilateral pes planus
10% for patellofemoral pain syndrome
10% for right ankle sprain
20% for cervical strain These individual ratings need to be strategically linked to achieve a higher overall rating. Additionally, I suffer from degraded disks in both my cervical and lumbosacral areas, resulting in chronic pain in my upper and lower back. Although I don’t have a specific rating for depression, but I do have the symptoms because of my chronic pain, I would like to add it as a secondary, I’m keen to improve my overall rating. What steps should I take?

I already been denied for my lower back 2 times in which I’m in the process of a higher level review. I already have current diagnosis and had a nexus letter and was still denied

My lower back is currently diagnosed as right side radiculopathy degenerative disc and pinched nerves in my lower back. What else can I do?

My claim for chronic pain was just denied today. Today has been very rough and I have been obsessing over solutions. They said "We have continued the assigned 20 percent evaluation for your thoracic back strain (claimed as chronic pain secondary to your service connected back condition) based on:
-Forward flexation of the thoracolumbar spine greater than 30 degrees but not greater than 60 degrees."
I am so confused and disheartened because I filed for "chronic pain as a secondary to my thoracic strain" So why are they just focusing on my thoracic back strain? Did my local VA officer word the form incorrectly to get the VA to only focus on the back strain and not the chronic pain secondary condition?

With this being a mental health rating, if I already have 70% for combat related PTSD, does that matter or can we get another mental health rating?
