i was an insurance agent for a year, primarily with elderly, recently retired clients. its dirty work, they train you to be direct and indiscriminate in terms of target with making money. “if they have a checkbook, they need us”

They increase profit by decreasing payout. Your client paid for 1M in coverage, but DIDN'T get 1M in coverage... sounds like insurance fraud ❗️❗️❗️

It’s really annoying. Defense lawyers rarely have any settlement authority at all anymore.

No way to demand expenses back so that the defendant has to pay for the mediation you don't want?

Most mediators are retired defense attorneys too.

It always amazes me that EVERY case is "worth" policy limits. Even when you dont even know what they are.

They probably had some case of lawyers working together, to squeeze as much as possible from insurance companies. So this might be a way to protect themselves from that happening.

Aren’t there any laws against it ?

Here in the UK we have a law - Conspiracy to Defraud Solicitors & Barristers. Be it your own or the other side. And it carries a mandatory 10 year sentence and a huge fine. And to qualify all it has to happen is that you intentionally doesn’t disclose to your lawyer something that he asked for and that’s absolutely necessary for the conclusion of the case.
Also if one is charged with it (can be a motion, can happen in the middle of a trial as well, if opposing counsel brings it up, something like they didn’t give a figure as to the amount they can settle in order to force mediation), the judge would then ask the opposing lawyer, did you ask them for it ? If he had asked he would immediately charge the people who didn’t disclose the information.
So in america you guys don’t have anything like that ?
