Smith fulfilled his obligation to provide a report to the AG that sets out his reasons for either prosecuting or not prosecuting. Volume 2 will have somewhat similar structure. Smith was concerned to only prosecute 'Mr' Trump, Civilian, and not "President' Trump. This prosecution would have been a slam dunk and Meek Merrick Garland will suffer the barbs of history when history reports he sat on his thumb for two years and did nothing.

Federal criminal prosecution of Trump for January 6 was an unsound legal strategy from the start. Instead, under their criminal laws, the states affected by Trump's actions should have criminally prosecuted him.

Under Article III of the Constitution, 28 USC secs 1251, 1253, 1331, and 1332, all federal courts are courts of limited jurisdicition. Federal courts are not designed to hear traditional criminal claims. There are no federal criminal statutes for inciting a riot, a public nuissance, etc. Additionally, the SCOTUS ruling on immunity has made the possibility of federal criminal pro even more difficult. Further, the restrictions on DOJ comment about the criminal prosecution of Trump during elections dramatically weakend the opportunities for exposure of his egregious conduct. Perhaps, most significantly, by prosecuting Trump federally, we gave Trump gasoline to pour on the political fires and set ourselves up for failure.

Unlike the federal courts, the founders intended for criminal law to be the province of the states. All the states, along with the District of Columbia, possess statutes that explicitly address Trump's actions on January 6. The state attorney generals woud have been under no restrictions about commenting on the status of the prosecution during the elections of 2022 and 2024. With state court criminal prosecution of Trump, the very real possibility exists that Trump would have been incarcerated before 2024, we would have calmed the political waters, and we would have preserved the integrity of the judicial process.

Therefore, we should have prosecuted Trump in state courts and not federal courts.
