An NRI can claim TDS by filing Income Tax Return in the following scenarios:
1. When his total income is less than the basic exemption limit, then he can claim the refund for the TDS available in Form 26AS.
2. If an NRI sells his properties located in India, TDS will be deducted on the sum received by NRI as per Section 195 of the Income Tax Act. Usually, the deducted TDS will be higher than the tax liability in these cases. So, the NRI can get a refund of the tax which is over and above the tax liability.

However, to avoid the fund’s blockage, an NRI can get a certificate for a lower deduction of tax under section 197 from the jurisdiction assessing officer.

Please suggest if the following understanding is correct:

An NRI earns ₹10L from NRO FD interest per annum. The bank deducts 31.2% as TDS, which is ₹312, 000.
Considering no other income or investments in India, his/her actual tax liability is ₹62, 400 (as per the tax slab calculation 115BAC for AY2024-25).
The extra TDS paid (₹312, 000 - ₹62, 400 = ₹249, 000) can be recovered by filling ITR at the end of the financial year.

Hello..coul dyou plz clarify below queries:-
1. Lets say if I have 2 accounts and after becoming NRI do i need to convert both SB accounts to NRO or only 1 bank where in which my NRE account is there.
2. Also, lets say after converting both SB to NRO, the total interest comes around 15K so does that mean whatever the tax (i.e. 31.2% +ed cess) will be deducted and since the value is less than 5 lakhs we can get full return. Is the return process straightforward like how we fill ITR .

Thanks,
