What Makes a BIG Workers Comp Settlement?

What makes for a BIG workers comp settlement? It's usually down to three things: your pre-accident wages, how bad your injury is, and how much work you've missed. Higher earners with serious injuries often see bigger payouts, but it's not a hard rule. For injuries to arms, legs, shoulders, or knees, it's all about the permanent disability. So sometimes returning to work sooner doesn't hurt your settlement. Just remember, bigger injuries typically mean bigger settlements.

It’s very difficult to work 8 hours as a caregiver with rotator cuff surgery, arthroscopic knee surgery and numerous herniated disc in my lumbar spine. Muscl relaxers help me to move around some but it wears off like everything else that suppose to minimize the pain and ROM. I’m drowning in bills and not able to go back to work yet. Being revictimized is the name of this Worker’s Compensation Game unfortunately.

I have been out of work for 130 days due to a slip and fall injury at my workplace, which led to a one-level Anterior Cervical Discectomy and Fusion (ACDF) surgery. My surgeon has determined that I am 100% permanently partially disabled.

What are the typical outcomes for these types of cases in NYS?
