Fourth amendment violation is also when an officer misleads a judge to get probable cause for a warrant. They’re not legally able to withhold information they know a judge would want to know when making a probable cause determination. They can’t say “this person swerved off of the road and killed two people” when they know the true story is “a car came into oncoming traffic forcing this car off of the road, which struck two people and killed them”. You would be surprised how much they withhold information to get probable cause for an arrest warrant . But if you don’t know no better you’ll just let it slide. It’s deception, it’s just as bad as a lie.

Violation of the 4th amendment just got new life from Supreme court...“We hold that the application of physical force to the body of a person with intent to restrain is a seizure, ” Chief Justice John Roberts wrote for the majority, “even if the person does not submit and is not subdued.”

We need better laws for this. I have one of the worst cases of privacy invasions. My Data, Cell Phone, Social Media, Online Accounts, Brain were all horrifically invaded. I was stripped of privacy for no reason. All I can think of is that I was outspoken about unethical practices at a former job and that P-ed off someone high up. I have a right to privacy and not being tracked/exploitation.

thank you..we had to learn our constitution and pass a test in order to graduate 8 th grade..
But at 70 I forgot a lot of the points. However, I do get the essence of the document's intent..,
and that is; we are OF common law and not law of the sea....thx again.

I have a question . If your book bag is in someone's car, and the driver has committed a crime and I'm a passenger, will I be committed that crime ? Or are they allowed to search in my bookbag

The "reasonable" part is too vague. That's why the 4th Amendment is violated all the time.

I know this is old, but I have to ask; does the 4th ammendmet apply to private citizens and/or private businesses in the same way it applies to the government/government agents.

If you have drugs for example, can the cops come in your home, seize your drugs without probable cause, and not arrest you, due to the illegal search, and both parties move on with their day ? Or can the person sue the cops for the violation?

4:10 this does not meet PC or RAS of a crime. Is the officer going to use this to pat down everyone.
